Petitioner appealed Respondent’s denial of his application for a resident insurance agent license. In 2011, Petitioner pled guilty to one felony count of first degree fraud. Under the First Offender Act, Petitioner was discharged without a court adjudication of guilt. Petitioner’s fraud charge related to signing a legal document that purported to be an eviction notice ordered by a magistrate court judge. Petitioner signed in the line designated for the judge’s signature. Respondent may refuse applicants who are charged and sentenced for the commission of a felony, even without an adjudication of guilt. Petitioner failed to prove by a preponderance of the evidence that his application should be granted. Accordingly, the Judge DENIED Petitioner’s application.
