The Commission sought to revoke Respondent’s real estate license. In April 2012, Respondent pled guilty to two felony counts to selling marijuana, one felony count of possession of marijuana with intent to distribute, and two misdemeanor counts of possession of a drug related object for distribution. Respondent provided the Commission with written notice of his conviction. Respondent testified that he voluntarily began undergoing drug testing and the results have been negative. At the hearing, Respondent presented three respected members of the real estate community who testified that Respondent was honest and trustworthy. Respondent satisfactorily demonstrated that he had a good reputation for honesty, trustworthiness, integrity and competence. The Judge concluded that revocation would be too harsh and thereby SUSPENDED Respondent’s license for three months and required Respondent to comply with the terms of his probation and submit to the Commission drug screen test results every quarter.
