The Georgia Department of Insurance denied Petitioner’s Resident Insurance Agent License Application due to Petitioner’s non-disclosure two separate criminal convictions in 2009 – one a misdemeanor shoplifting offense, and the other an attempted armed robbery – on his license application and because he received a first offender sentence for a felony as a result of the latter conviction.  The denial of Petitioner’s application was reversed in light of evidence of that Petitioner had obtained employment, enrolled in college, and demonstrated excellent character in the years since his conviction.  However, given the nature of the offense and the fact that Petitioner remained on no show/no report probation, the Court recommended issuance of a probationary license.
