The Georgia Department of Natural Resources issued a permit to the City of Guyton to construct a land application system (LAS), which applies treated wastewater to land via irrigation system. The Petitioner, an adjacent land owner, argued surface water and groundwater from the LAS site would enter his land and contain levels of constituents that are harmful to aquatic species.  The Department lawfully issued the permit because it complied with Georgia’s antidegradation rule and water quality standards, substantially complied with LAS guidelines, and the facility had the ability to comply with its permit.
