Revocation of registration to operate daycare does not require denial of paraprofessional license.

The Professional Standards Commission denied Petitioner’s paraprofessional license application due to a 2012 arrest that resulted in the revocation of her registration to operate a daycare center.  Petitioner was arrested for Cruelty to Children in 2012 due to her conduct in leaving children in her care alone with a gun and subsequently allowing two of the children to engage in a physical altercation.  She later pleaded guilty to misdemeanor reckless conduct.  The Court held that the denial of Petitioner’s application was improper, as a registration to operate a daycare center was not a “professional license,” revocation of which would justify the denial of her application.  Further, Petitioner was not convicted of a felony, a crime of moral turpitude, or any other law applicable to the profession for which she sought licensure.
