Childcare facility’s license revoked following criminal charge of child molestation

In this case, the Department of Early Care and Learning (DECAL) revoked the license of a family childcare learning home after the owner’s husband, who was also an employee of the facility, was arrested on a charge of child molestation. The Court upheld the license revocation after concluding DECAL had proved the facility had violated rules involving physical and sexual abuse of a child.  However, the Court noted that DECAL failed to prove violations of the criminal background check rule.
