In granting a candidate’s motion to dismiss, an OSAH Judge concluded that this particular adverse action—which the Georgia Government Transparency and Campaign Finance Commission commenced itself, as opposed to being commenced by a third-party complaint—fell outside the relevant statute of limitations.
Update: On January 28, 2022, the chairman of the Georgia Government Transparency and Campaign Finance Commission issued an order reversing the OSAH Judge’s decision. (Click here for the chairman’s order.) This reversal order was subsequently appealed to the Superior Court of Fulton County, Case No. 2022CV361097. On May 13, 2022, the superior court dismissed the matter with prejudice. (Click here for the superior court’s order.)
