On motions for summary determination and dismissal, Judge Miller determined that Petitioner, a teacher, did not violate Standard 2 of the Code of Ethics for Educators, which bars teachers from engaging in unethical conduct with regard to students. Petitioner allegedly allowed a student, who had been kicked out of her house, to sleep over. Standard 2, which lists indisputably inappropriate (and often illegal) conduct, does not encompass the behavior at issue in this case. Issues preserved for hearing include whether Petitioner violated Standard 4 (Honesty), Standard 9 (Failure to Report), and Standard 10 (Professional Conduct).
