A 14-year-old student and her mother alleged that the student’s school district violated the Individuals with Disabilities Education Act (IDEA) with respect to the student’s identification, evaluation, and educational placement, as well as by denying her a free appropriate public education (FAPE). The Court granted a motion for involuntary dismissal on all but two claims. After reviewing the evidence presented by both parties, the Court ultimately denied the student’s and mother’s request for relief on the remaining claims because there was insufficient evidence that the school district failed to identify an emotional behavioral disability and properly evaluate for it.
