Petitioner appealed the Department of Community Health’s decision to terminate Petitioner’s SOURCE Program benefits. Petitioner was diagnosed with demyelinating neuropathy and Charcot neuroarthropathy, which cause difficulty walking and an increased risk of falling. Petitioner needed active assistance with multiple activities of daily living, including cooking, cleaning, dressing, taking medication, and bathing. Two of Petitioner’s specialists credibly testified that Petitioner met SOURCE’s nursing home level of care eligibility criteria. Thus, the Judge REVERSED Respondent’s decision to terminate Petitioner’s SOURCE assistance.
