An environmental nonprofit challenged the Environmental Protection Division’s (EPD’s) reissuance of three general permits allowing stormwater discharge associated with construction activity. The Court dismissed the case, finding that the nonprofit lacked standing to bring the challenge. Specifically, the nonprofit was not able to demonstrate an actual or imminent “injury in fact” that was traceable to the permits’ issuance. The nonprofit also failed to establish that its alleged injury could be redressed by a decision from this Court.
Update as of 5/16/2024: Judicial review remains pending before the Superior Court of Fulton County, Case No. 24CV000095.
