Judge determined that Petitioner, a nurse aide, did not willfully abuse an elderly patient. The now-deceased patient suffered from dementia and was known to have made unsubstantiated allegations of abuse in the past. The sole witness was not reliable. While the nursing home resident may have had bruises on her wrist, the evidence indicated that Petitioner did not willfully harm her. The Department’s decision to list Petitioner on the Nurse Aide Registry for abuse was, therefore, reversed.
