The Supreme Court of Georgia considered claims regarding the Child Protective Services Information System (the Act) and determined that (1) the child sex abuse offender whose name was added to the Child Abuse Registry failed to show the deprivation of a liberty or property interest based on injury to his reputation and impact on future job prospects; (2) the Act is not unconstitutional as applied to the offender; (3) the Act is civil, not punitive or quasi-criminal; (4) the Act does not violate the separation of powers doctrine; (5) the ALJ’s decision that the abuser committed an act of child sex abuse was supported by evidence.

Appellate review

In this matter regarding a National Pollutant Discharge Elimination System permit, the Court of Appeals vacated the order of the superior court to the extent that it affirmed the issuance of the permit, and it remanded with direction that the superior court in turn remand the case to the ALJ for reconsideration. The Court of Appeals determined that the ALJ should apply a different interpretation of the narrative water quality standard.

No violation of Child Find

Although the District could have acted with more urgency, it did not violate the Child Find provisions of IDEA, which require it to identify and evaluate a child with a suspected disability within a reasonable amount of time.
